How an EHCP affects getting into a school
At the draft EHCP stage, you are requested to name an education for Section I of your child or young person's EHCP.
You can make a request for your child to attend an education setting that you like.
The types of education settings you can request are:
- a maintained school or nursery (mainstream school)
- an Academy (mainstream school)
- a further education setting (college or sixth form)
- a non-maintained special school
- a Section 41 school (independent special school)
We will then send the draft plan to the education setting to see if they can meet your child’s needs. This is called consultation.
The setting must respond to the consultation stating within 15 days telling us if they can meet your child or young person’s needs.
If your choice cannot meet your child or young person’s needs
You will have a chance to choose a new first choice if there is enough time.
We will have to create a final plan naming a setting by the 20-week deadline.
Once your child or young person has been issued a final EHCP
The education setting named in the plan is the one they will need to attend.
If you disagree with the named education setting you can make an appeal.
