Lodgers and subletting your council home

As a council tenant, you cannot sublet or part with possesson of your whole home. This is stated in legislation and in your tenancy agreement.

However, you may be able to take in lodgers or sublet part of your home.

To take in a lodger or sublet part of your home

You need:

  • a full tenancy (not a probationary tenancy)
  • a spare room
  • permission from us

If we refuse permission and you think this is unreasonable, you have the right to challenge our decision.

Subletting without our permission is a breach of the terms and conditions of your tenancy agreement.

If you receive Housing Benefit

You need to report a change in circumstances for Housing Benefit when you take in a lodger or sublet.

If a friend or family member comes to live with you

Athough this is not subletting or taking in a lodger, it does mean a change to your household composition. You must let us know about this as part of your tenancy agreement.
