You can assign your tenancy to someone who would be entitled to succeed your tenancy if you were to die.
What to think about before you assign
You should seek legal advice.
You should be aware that assigning a tenancy counts as a succession and no further succession is allowed. This means the person you're assigning to cannot:
- assign it to anyone else
- pass the tenancy onto someone if they were to die
Assigning your tenancy means you will no longer have any of the rights and protection your tenancy provides.
If you plan to remain living at the property with the assignee, you are vulnerable to being asked to leave at any time. If you were to have to leave, you would need to make your own arrangements for future housing. You may be considered intentionally homeless if you approach us for help with housing.
